Last Entry: 09/05/2016 - Winston Hills Committee advises legal appeal not possible. I believe the law has been tipped in favour of financial interests instead of listening to a community who will be directly affected by the construction. There is something seriously wrong with the law where by over 400 persons objecting to the erection of a building are overruled by a stroke of a pen by persons who do not even live in proximity of the construction. The law is seriously in dire need of change whereby community must have a greater say in the erecting of buildings as they are the people being directly affected. I would advocate a law whereby perhaps there needs to be 75% agreement by all persons within a certain perimeter of the construction prior to the construction and planning occuring. 15/04/2016 - Land Environment Court - Final Appeal Decision. – What a sad day it is. The final decision is on PAGE 23 of the PDF file. It states under section 103 point 1 “The appeal is upheld”. point 2 “erection of a residential flat building at the Winston hills Shopping mall …. is approved subject to conditions Annexure A” On a positive note, it was truly great to see the community come together and I feel this issue has brought us closer as a community.
